15 A Beneficiary must be nominated by the Policyholder on the Policyholder Application Form each time a Payment Book is issued. Such Beneficiary will remain as such until changed by the Policyholder. A Policyholder may at any time nominate another Beneficiary by completing an Amended Policyholder Application Form and such person will be the Beneficiary until: • changed again by the Policyholder; or • a Continuation Payment Book or a Replacement Payment Book is issued, and a new Policyholder Application Form is completed. Notwithstanding that a Beneficiary nominated by a Policyholder is recorded by a Church Branch Committee Member in the Payment Book or by Kganya Botswana in its records, no representation as to the validity or otherwise of the appointment or the identification of the Beneficiary shall be construed by such recording. Where a Policyholder has not nominated a Beneficiary or the Beneficiary: • was not validly appointed; • is a minor or otherwise legally disqualified; • is deceased; • cannot be identified with reasonable certainty; • is indisposed or unreachable; or • is not considered to be a suitable person by the Policyholder’s Church Branch Committee Members or Kganya Botswana, Kganya Botswana will request the Policyholder’s Church Branch Committee Members to nominate the Beneficiary and such nomination will be final and binding. The provisions hereof shall not be construed as placing an onus on Kganya Botswana or the Policyholder’s Church Branch Committee Members to determine the suitability or otherwise of the Beneficiary. Where the death is that of: • a Policyholder (“the First Policyholder”) and there are competing Claims between the Beneficiary of the First Policyholder and another Policyholder claiming the deceased was a Dependant, then the Claim of the First Policyholder will prevail. • a person who became entitled to Paid-up Benefits on the death of the First Policyholder and the competing Claims are between the Beneficiary of the first Policyholder and another Policyholder claiming that the deceased was a Dependant, the Claim of the person who in the opinion of the deceased‘s Church Branch Committee Members is regarded as the guardian will prevail.
